There are numerous laws on the books in Indiana for theft charges, each with its own statutory definition and applicable penalty. The two main categories, though, are petty and grand theft, and the crimes are separated by the dollar amount assigned to the stolen property. The value of the property may be determined in different ways, including how much it would cost to replace the item(s).

Per Indiana Code 35-42-4-2-(a), theft crimes are classified and penalized as follows:

  • Class A misdemeanor theft: Also called petty theft, this involves the alleged theft of property less than $750, and those convicted face up to 1 year in jail and up to a $1,000 fine.
  • Level 6 felony theft: Also called grand theft, these felony charges carry much harsher penalties and stay on your permanent record. Level 6 felony theft involves stolen property valued between $750 and $50,000, or if the person had a prior theft conviction. The penalty for conviction is between 6 months and 2.5 years in prison, and up to a $10,000 fine.
  • Level 5 felony theft: The most serious of all theft crimes in Indiana, the stolen property is valued at more than $50,000. Those convicted face a minimum of 1 year and up to 6 years in prison, and up to a $10,000 fine. If other crimes were committed in conjunction with the theft, penalties increase.
